제1조 (목적)

이 약관은 KANGSIUM Co., Ltd.(이하 "회사")가 제공하는 Android 앱 "Forkprint"(이하 "서비스")의 이용 조건과 회사와 이용자의 권리·의무를 정합니다. 회사의 정보: 대표자 강병진, 전북특별자치도 익산시 학곤로 6-2, 2층 (54668), jason@kangsium.com.

제2조 (정의)

제3조 (약관의 게시와 개정)

  1. 회사는 이 약관을 이 페이지와 앱의 프로필 탭에 게시합니다.
  2. 회사는 「약관의 규제에 관한 법률」 등 관련 법령을 위반하지 않는 범위에서 이 약관을 개정할 수 있습니다. 개정 사유는 법령의 변경, 서비스 내용의 변경, 보안상 필요, 또는 문구의 명확화에 한합니다.
  3. 개정 약관은 적용일 7일 전(이용자에게 불리하거나 중대한 내용은 30일 전)부터 적용일 전날까지 이 페이지와 앱 안의 알림으로 공지합니다. 개정 약관에 동의하지 않는 이용자는 서비스 이용을 중단하고 앱에서 계정을 삭제할 수 있습니다. 공지에는 적용일까지 거부 의사를 밝히지 않고 서비스를 계속 이용하면 개정 약관에 동의한 것으로 본다는 뜻을 함께 적으며, 그 경우 동의한 것으로 봅니다.

제4조 (서비스의 내용)

  1. 서비스는 식사한 장소와 그 평가를 기록하고, 기록을 기기 간에 동기화하며, 추천을 제공하는 무료 앱입니다. 광고와 유료 기능이 없습니다.
  2. 추천은 자동으로 만들어지는 제안일 뿐이며, 장소의 품질, 영업 여부, 위생, 가격을 보증하지 않습니다. 장소 정보는 공개 데이터(Overture Maps)와, 이용자가 직접 요청한 경우 Google Maps에서 가져오며 실제와 다를 수 있습니다.
  3. 서비스는 Android 8.0 이상에서 동작하며, 현재 Android 16을 기준으로 개발됩니다. 일부 기능(주변 검색, 추천)은 인터넷 연결이 필요합니다.
  4. 서비스는 "있는 그대로, 이용 가능한 범위에서" 제공됩니다. 회사는 서비스를 개선하기 위해 기능을 추가·변경할 수 있으며, 이용자에게 불리한 변경은 제3조와 같이 공지합니다.

제5조 (이용계약과 연령)

  1. 이용계약은 이용자가 앱에서 나이를 확인하고 "시작하기"를 눌러 이 약관에 동의하는 때에 성립합니다. 회사는 동의한 약관의 버전과 시각을 익명 계정에 기록합니다.
  2. 서비스는 만 16세 이상만 이용할 수 있습니다. 이용자는 자신이 만 16세 이상임을 확인합니다. 만 16세 또는 17세 이용자의 거주지 법령이 보호자의 동의를 요구하는 경우, 이용자는 그 동의를 받았음을 확인합니다. 미국의 기기에서는 회사가 Google Play가 제공하는 연령 신호를 존중합니다.
  3. 계정은 익명이며 휴대폰에 묶여 있습니다. 회사는 이름, 이메일, 비밀번호를 요구하지 않으며, 분실한 계정을 복구해 드릴 수 없습니다.

제6조 (이용자의 기록)

  1. 이용자의 메모와 사진은 이용자의 것입니다.
  2. 이용자는 회사에 기록을 저장·동기화·내보내기하고, 기록한 장소와 평가로 추천 모델을 학습·운영하는 데(메모와 사진은 학습에 쓰지 않습니다) 필요한 범위에서, 비독점적이고 무상이며 철회 가능한 이용허락을 부여합니다. 이 허락은 이용자가 해당 기록이나 계정을 삭제하면 종료됩니다(백업본은 최대 180일 안에 삭제됩니다). 프로필 탭에서 "내 기록을 추천 학습에서 제외"를 켜면 모델 학습에서 제외됩니다.
  3. 이용자는 첨부하는 사진이 본인에게 권리가 있는 것임을 보증합니다.
  4. 기록은 비공개이며 다른 이용자에게 보이지 않습니다. 회사는 법령상 의무가 있거나 보안상 필요한 경우가 아니면 기록의 내용을 들여다보지 않습니다.

제7조 (금지행위)

이용자는 다음 행위를 해서는 안 됩니다: 서비스의 보안을 우회하거나 다른 이용자의 데이터에 접근하려는 행위, 자동화된 수단으로 서비스에 과도한 요청을 보내는 행위, 타인의 권리를 침해하거나 법령에 위반되는 내용을 저장하는 행위, 서비스를 역설계하여 Google Maps 등 제3자 서비스의 약관을 위반하는 행위. 회사는 위반이 확인되면 해당 계정의 이용을 제한하거나 계정을 삭제할 수 있으며, 그 사유를 앱 안의 알림으로 알립니다.

제8조 (서비스의 변경과 중단)

회사는 점검, 장애, 제3자 서비스의 중단, 법령상 사유로 서비스의 전부 또는 일부를 일시 중단할 수 있으며, 가능한 경우 미리 공지합니다. 회사가 서비스를 종료하기로 하면 종료일 30일 전까지 공지하고, 이용자가 그 기간 동안 기록을 내보낼 수 있도록 합니다.

제9조 (계약의 해지, 내보내기, 청약철회)

  1. 이용자는 언제든 앱의 프로필 탭에서 "내 데이터 삭제"를 눌러 계약을 해지할 수 있습니다. 서버와 휴대폰의 모든 데이터가 삭제됩니다.
  2. 해지 전에 "내 데이터 내보내기"로 기록과 사진을 기계가 읽을 수 있는 형식(ZIP)으로 받을 수 있습니다.
  3. 서비스는 무료이며 동의 즉시 제공이 시작됩니다. 청약철회가 적용되는 지역의 이용자는 계정을 삭제하는 방법으로 철회할 수 있으며, 환불할 금액은 없습니다.

제10조 (책임의 제한)

  1. 회사는 고의 또는 중대한 과실로 인한 손해, 사기, 그리고 사람의 생명·신체에 대한 손해에 대한 책임을 제한하지 않습니다.
  2. 회사에 고의 또는 중대한 과실이 없는 경우에 한하여, 무료로 제공되는 서비스의 성격상 회사는 추천이나 장소 정보의 부정확, 서비스의 중단이나 데이터 손실(특히 앱 삭제나 기기 변경으로 익명 계정을 잃은 경우)로 인한 간접 손해나 기대이익의 상실에 대해 책임지지 않습니다. 단, 회사의 책임이 법령상 배제될 수 없는 범위에서는 그러하지 않습니다.
  3. 이 조항은 이용자가 거주지의 소비자 보호 법령에 따라 갖는 권리를 제한하지 않습니다.

제11조 (보안과 취약점 신고, 지원 기간)

보안 취약점은 보안 페이지의 안내에 따라 jason@kangsium.com으로 알려 주세요. 회사는 3영업일 안에 접수를 확인합니다. 회사는 서비스에 대한 보안 업데이트를 최소 2028년 12월 31일까지 제공하며, 지원 종료일을 바꿀 때는 6개월 전에 이 페이지에 공지합니다.

제12조 (Google Maps 콘텐츠)

서비스의 "Google Maps에서 검색" 기능은 Google Maps Platform을 사용합니다. 이 기능으로 표시되는 콘텐츠에는 Google Maps/Google Earth 추가 서비스 약관과 Google 개인정보처리방침이 적용됩니다.

제13조 (준거법과 관할)

이 약관에는 대한민국 법이 적용됩니다. 회사와 이용자 사이의 소송은 민사소송법에 따른 관할법원에 제기합니다. 대한민국 밖에 거주하는 이용자의 경우에도 이 조항은 거주지(유럽연합, 영국, 일본, 미국의 각 주 등)의 강행적 소비자 보호 법령에 따라 갖는 권리와 거주지 법원에서 재판받을 권리를 제한하지 않습니다.

제14조 (분쟁의 사전 협의)

분쟁이 생기면 소송에 앞서 jason@kangsium.com으로 알려 주시고, 회사와 이용자는 30일 동안 성실히 협의합니다. 회사는 중재 조항을 두지 않으며, 이용자가 집단소송 등 법령상 권리를 포기하도록 요구하지 않습니다.

부칙

이 약관은 2026년 10월 22일부터 시행합니다(버전 2026-10). 한국어본이 기준이며 영어본과 차이가 있으면 한국어본이 우선합니다. 개인정보의 처리에 관한 사항은 개인정보 처리방침을 따릅니다.

1. Who you are dealing with

These terms govern the Android app Forkprint ("the service"), provided by KANGSIUM Co., Ltd. ("we"), represented by Kang Byeong-jin (Jason Kang), 6-2 Hakgon-ro, 2nd Floor, Iksan-si, Jeonbuk State 54668, Republic of Korea, jason@kangsium.com.

3. Publication and changes to these terms

  1. These terms are published on this page and in the app's Profile tab.
  2. We may change them only for these reasons: a change in the law, a change in the service, a security need, or to make the wording clearer.
  3. Changes are announced on this page and with an in-app notice at least 7 days before they take effect, or 30 days for changes that are material or to your disadvantage. If you do not agree with a change you may stop using the service and delete your account in the app. The notice says so as well: continuing to use the service after the effective date, without objecting, means you accept the change.

4. The service

  1. Forkprint is a free app for logging the places you ate at and how they felt, syncing that journal between your devices, and receiving recommendations. There are no ads and no paid features.
  2. Recommendations are automated suggestions only. We make no promise about a place's quality, opening hours, hygiene or prices. Place data comes from public data (Overture Maps) and, when you ask for it, from Google Maps, and may be wrong.
  3. The service runs on Android 8.0 or later and is developed against Android 16. Some features (nearby search, recommendations) need an internet connection.
  4. The service is provided "as is" and "as available". We may add or change features to improve it; changes to your disadvantage are announced as in section 3.

5. Your account and your age

  1. The contract starts when you confirm your age in the app and tap "Get started", which accepts these terms. We record the version and time of your acceptance on your anonymous account.
  2. You must be 16 or older to use the service. You confirm that you are. If you are 16 or 17 and the law where you live requires a guardian's consent, you confirm that you have it. On devices in the United States we honour the age signals that Google Play provides.
  3. Your account is anonymous and tied to your phone. We never ask for a name, e-mail address or password, and we cannot recover a lost account.

6. Your journal

  1. Your notes and photos are yours.
  2. You grant us a non-exclusive, royalty-free, revocable licence to store, sync and export your journal, and to train and run the recommendation model with the places you logged and your verdicts (never your notes or photos), as far as that is needed to provide the service. The licence ends when you delete the item or your account (backups clear within 180 days). Switching on "Exclude my logs from recommendations" in the Profile tab removes your journal from model training.
  3. You warrant that the photos you attach are yours to use.
  4. Your journal is private and never shown to other users. We do not look at its content unless the law obliges us to or security requires it.

7. What you must not do

Do not try to bypass the service's security or reach other users' data; do not flood the service with automated requests; do not store content that infringes others' rights or breaks the law; do not reverse-engineer the service to misuse third-party services such as Google Maps. If we find a breach we may restrict or delete the account and will say why in an in-app notice.

8. Changes to and suspension of the service

We may suspend all or part of the service for maintenance, outages, the suspension of a third-party service, or legal reasons, with advance notice where possible. If we decide to end the service we will announce it at least 30 days ahead and let you export your journal in the meantime.

9. Ending the contract, export, withdrawal

  1. You may end the contract at any time with "Delete my data" in the app's Profile tab. Everything on our servers and on the phone is erased.
  2. Before that, "Export my data" gives you your journal and photos in a machine-readable format (ZIP).
  3. The service is free and starts immediately when you accept these terms. Where a right of withdrawal applies, you exercise it by deleting your account; there is nothing to refund.

10. Liability

  1. We do not limit our liability for death or personal injury caused by our negligence, for fraud, or for intent or gross negligence.
  2. Where we are not at fault by intent or gross negligence (ordinary negligence only), because the service is free, we are not liable for indirect loss or lost expectations arising from inaccurate recommendations or place data, from interruptions, or from data loss (in particular a lost anonymous account after an uninstall or a change of phone), except where the law does not allow such a limitation.
  3. Nothing in these terms affects your statutory rights as a consumer where you live.

11. Security, vulnerability reports, support period

Please report security vulnerabilities to jason@kangsium.com as described on the security page; we acknowledge reports within 3 business days. We provide security updates for the service until at least 31 December 2028 and announce any change to that date on this page at least 6 months ahead.

12. Google Maps content

The "Search Google Maps" feature uses Google Maps Platform. Content shown through it is subject to the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy.

13. Governing law and courts

These terms are governed by the law of the Republic of Korea, and disputes between us go to the court with jurisdiction under the Korean Civil Procedure Act. This does not limit the protection you have under the mandatory consumer law of the place where you live (the European Union, the United Kingdom, Japan, a US state and so on), nor your right to bring or defend a claim in your home courts.

14. Talking first

If a dispute arises, write to jason@kangsium.com before going to court; we will try in good faith to resolve it within 30 days. There is no arbitration clause, and we do not ask you to waive class actions or any other statutory right.

Final provisions

These terms take effect on 22 October 2026 (version 2026-10). The Korean text controls if the two versions differ. How we handle your data is described in the privacy policy.

第1条（目的）

第2条（定義）

第3条（規約の掲示と変更）

  1. 当社は本規約をこのページとアプリのプロフィールタブに掲示します。
  2. 当社は、関係法令（日本の民法の定型約款に関する規定を含みます）に反しない範囲で本規約を変更することがあります。変更の理由は、法令の変更、本サービスの内容の変更、セキュリティ上の必要、または文言の明確化に限ります。
  3. 変更後の規約は、適用日の7日前（利用者に不利または重要な内容は30日前）から適用日の前日まで、変更する旨、変更後の内容および効力発生日をこのページとアプリ内の通知でお知らせします。変更後の規約に同意しない利用者は、本サービスの利用をやめ、アプリでアカウントを削除することができます。お知らせには、適用日までに異議を述べずに本サービスを使い続けた場合は変更後の規約に同意したものとみなす旨を併せて記載し、その場合は同意したものとみなします。

第4条（本サービスの内容）

  1. 本サービスは、食事した店とその評価を記録し、記録を端末間で同期し、おすすめを提供する無料のアプリです。広告や有料機能はありません。
  2. おすすめは自動で生成される提案にすぎず、店の品質、営業状況、衛生、価格を保証するものではありません。店の情報は公開データ（Overture Maps）と、利用者が自ら求めた場合はGoogle Mapsから取得しており、実際と異なることがあります。
  3. 本サービスはAndroid 8.0以上で動作し、現在Android 16を基準に開発しています。一部の機能（周辺検索、おすすめ）にはインターネット接続が必要です。
  4. 本サービスは「現状有姿で、利用可能な範囲で」提供されます。当社はサービスの改善のため機能を追加・変更することがあり、利用者に不利な変更は第3条のとおりお知らせします。

第5条（利用契約と年齢）

  1. 利用契約は、利用者がアプリで年齢を確認し、「はじめる（Get started）」をタップして本規約に同意した時に成立します。当社は同意した規約のバージョンと日時を匿名アカウントに記録します。
  2. 本サービスは16歳以上の方のみ利用できます。利用者は自身が16歳以上であることを確認します。未成年者（18歳未満）の方は、法定代理人（親権者など）の同意を得たうえで本サービスを利用してください。未成年者が本規約に同意した場合、法定代理人の同意を得たものとみなします。米国の端末では、当社はGoogle Playが提供する年齢シグナルを尊重します。
  3. アカウントは匿名で、端末に結び付いています。当社は氏名、メールアドレス、パスワードを求めず、失われたアカウントを復元することはできません。

第6条（利用者の記録）

  1. 利用者のメモと写真は利用者のものです。
  2. 利用者は当社に対し、記録の保存・同期・エクスポート、および記録した店と評価によるおすすめモデルの学習・運用（メモと写真は学習に使いません）に必要な範囲で、非独占的・無償・撤回可能な利用許諾を与えます。この許諾は、利用者が該当する記録またはアカウントを削除した時に終了します（バックアップは最長180日以内に消去されます）。プロフィールタブで「自分の記録をおすすめの学習から除外する（Exclude my logs from recommendations）」をオンにすると、モデルの学習から除外されます。
  3. 利用者は、添付する写真について自身が権利を有することを保証します。
  4. 記録は非公開で、他の利用者には表示されません。当社は、法令上の義務がある場合やセキュリティ上必要な場合を除き、記録の内容を閲覧しません。

第7条（禁止事項）

利用者は次の行為をしてはなりません: 本サービスのセキュリティを回避し、または他の利用者のデータにアクセスしようとする行為、自動化された手段で本サービスに過大なリクエストを送る行為、他人の権利を侵害し、または法令に違反する内容を保存する行為、本サービスをリバースエンジニアリングしてGoogle Mapsなど第三者サービスの規約に違反する行為。違反が確認された場合、当社は該当アカウントの利用を制限し、またはアカウントを削除することがあり、その理由をアプリ内の通知でお知らせします。

第8条（本サービスの変更と中断）

当社は、保守、障害、第三者サービスの停止、法令上の事由により、本サービスの全部または一部を一時的に中断することがあり、可能な場合は事前にお知らせします。当社が本サービスを終了する場合は、終了日の30日前までにお知らせし、その期間中に利用者が記録をエクスポートできるようにします。

第9条（契約の終了、エクスポート、撤回権）

  1. 利用者はいつでも、アプリのプロフィールタブで「データを削除（Delete my data）」をタップして契約を終了できます。サーバーと端末のすべてのデータが削除されます。
  2. 終了の前に、「データをエクスポート（Export my data）」で記録と写真を機械可読な形式（ZIP）で受け取ることができます。
  3. 本サービスは無料で、同意と同時に提供が始まります。撤回権が適用される地域の利用者は、アカウントを削除する方法で撤回でき、返金すべき金額はありません。

第10条（責任の制限）

  1. 当社は、故意または重大な過失による損害、詐欺、および生命・身体に対する損害についての責任を制限しません。
  2. 当社に故意または重大な過失がない場合（軽過失の場合）に限り、無料で提供されるサービスの性質上、当社は、おすすめや店の情報の不正確、本サービスの中断、データの消失（特にアンインストールや機種変更により匿名アカウントを失った場合）による間接損害や逸失利益について責任を負いません。ただし、消費者契約法第8条その他の法令により当社の責任を免除できない範囲ではこの限りではありません。
  3. 本条は、利用者が居住地の消費者保護法令に基づいて有する権利を制限しません。

第11条（セキュリティ、脆弱性の報告、サポート期間）

セキュリティ上の脆弱性は、セキュリティページの案内に従って jason@kangsium.com へお知らせください。当社は3営業日以内に受領をお知らせします。当社は本サービスのセキュリティ更新を少なくとも2028年12月31日まで提供し、サポート終了日を変更する場合は6か月前にこのページでお知らせします。

第12条（Google Mapsのコンテンツ）

本サービスの「Google Mapsで検索」機能はGoogle Maps Platformを使用します。この機能で表示されるコンテンツには、Google Maps/Google Earth追加利用規約およびGoogleプライバシーポリシーが適用されます。

第13条（準拠法と裁判管轄）

本規約には大韓民国の法律が適用されます。当社と利用者の間の訴訟は、大韓民国の民事訴訟法に基づき管轄を有する裁判所に提起します。大韓民国外に居住する利用者についても、本条は、居住地（日本、欧州連合、英国、米国の各州など）の強行法規たる消費者保護法令に基づく権利、および居住地の裁判所で裁判を受ける権利を制限しません。

第14条（紛争の事前協議）

紛争が生じた場合は、訴訟の前に jason@kangsium.com へお知らせください。当社と利用者は30日間、誠実に協議します。当社は仲裁条項を設けず、利用者に集団訴訟などの法令上の権利の放棄を求めません。

附則

本規約は2026年10月22日から施行します（バージョン 2026-10）。韓国語版が正本であり、日本語版・英語版との間に相違がある場合は韓国語版が優先します。個人情報の取り扱いについてはプライバシーポリシーによります。
